Well, when a politician says they do not support something, you have to wonder what they DO support.
When they say that something doesn't happen, you should ask what DOES happen.
Now, look at the following quotes from our District Attorney: (Courtesy of The Chronicle)
“I hear all this about abuse, abuse, abuse, you have no
documented case in this county ever.”
“If you're driving in your car and you have cocaine in
your car, we can take your car and hold it as evidence in the case,” Hoovler said.
“Police departments do it every day because that's what they're supposed to do.
Most of the time we take pictures of your car, take pictures of where the
cocaine was found or where the evidence was found. We give you your car back.
Are there times where we hold the car? Absolutely. But I keep hearing all this
due process, due process, due process. If you're found guilty or you plead
guilty, you've had your due process.” (Oh! we could tear this entire statement apart but we will stick to the point)
What he didn't say was that there was a car held from a family in Warwick for 4 MONTHS!!!

How's that for documentation?
Also, the legally inclined members of the team wish to point out the definition of "due process of law", since it is apparent that our Chief Legal Officer, in the guise of District Attorney David Hoovler, doesn't seem to know. Or care.

due process of law
n. a fundamental principle of fairness in all
legal matters, both civil and criminal, especially in the courts. All legal
procedures set by statute and court practice, including notice of rights, must
be followed for each individual so that no prejudicial or unequal treatment
will result. While somewhat indefinite, the term can be gauged by its aim to
safeguard both private and public rights against unfairness. The universal
guarantee of due process is in the Fifth Amendment to the U.S. Constitution,
which provides "No person shall…be deprived of life, liberty, or property,
without due process of law," and is applied to all states by the 14th
Amendment. From this basic principle flows many legal decisions determining

police are holding” the vehicle. He said his office has not asked for it

Meanwhile, Chief Assistant District Attorney Robert Conflitti SAID:
“I don't know why police are holding” (the vehicle), indicating there wasn't a case in which they would hold the car-a 2008 Hyundai- for evidence.
Why didn't his boss, David Hoovler say that?
Maybe he didn't know.
