Andrew’s Affront and Felberman's Fantasy

Dear Nieces and Nephews, For the following story, please substitute the name of any religion for "Mystery religion/mystic" which Auntie made up. (if there really is a Mystery religion, oops!)

Suppose you were walking down the street and the person walking towards you suddenly turned around as they passed and hit you in the head. S/he then starts to kick you in the stomach after knocking you down. You, being a reasonable but not foolish person, manage to collect yourself and start fighting back. You are defending yourself.

A few months later, you and the perpetrator of this injustice, appear in court and during the trial the perp’s lawyer said that you when you “lashed out in a violent manner at my client; you did so because my client is a member of the Mystery Religion, S/he is a Mystic”.

There is a hush in the courtroom and the lawyer continues with this line of statement and questioning, Mystics in the room are starting to grow apprehensive and even angry. One person blurts out “This type of Anti-Mystic prejudice should not be tolerated in America!”  The lawyer then refers to events in history when Mystics were massacred en masse  and the “historical” guilt takes over.

Tensions swell until the Judge shouts “Order, Order in the court!!! Bailiff, remove the instigators!”

Calm returns but there are some Mystics on the jury who have already made up their minds about the verdict. And the others who were not Mystics, afraid of being called prejudiced, voted to acquit.

“Wow”, you think to yourself “I didn’t even know S/he was a Mystic, I was just defending myself.”

But it is too late and eventually the perp’s lawyer got what they were going for, a jury either too angry or too afraid to convict and so, your perp walks. AND YOU get arrested for assault.  Then, to top it off, S/he, through their lawyer, calls for Civil Discourse and Mutual Respect.

“But YOU are the one who beat me up for no reason!!!” you exclaim.

And your Attorney/Spokesperson, who vigorously represented you, is portrayed in the media as angry and Anti-Mystic.

“Can’t happen” you say. “Surely you exaggerate, Auntie”

“Oh, Really?” replies your Auntie. What happened at that annexation meeting? Supporters of annexation did not discuss the environmental impacts but did refer to opponents of annexation as supporters of Auschwitz. What has happened as a result of the annexation bill veto by the Governor? More rhetoric with unsubstantiated claims of prejudice that have nothing to do with the bills presented.

These continual references to a malevolent historical event only serve to sensationalize the issue and deflect away from what is really happening.

But isn’t that the point? Deflect, so we won’t pay attention to the real issues.

Andrew’s rationale for the veto (THR Friday 7-10-15 C. McKenna):

(Cuomo) He said in his message that the measure would violate the state constitution by giving counties "control over local annexation petitions that would not impact a county's boundaries," an argument Kiryas Joel's attorneys also had made.

Assemblyman Skoufis correctly pointed out, the one bill does not involve the “governing body” aka legislature. It would not have required consent but only allow the County to make recommendations, which could be overridden by a supermajority vote of the local boards, e.g. Village of Kiryas Joel and Town of Monroe boards. (Maybe the Monroe board is not 4/5 in favor) (The other bill that was vetoed would allow the DEC commissioner to consider the environmental record of the involved agencies when choosing lead agency-what is wrong with that, Andy???)

Andrew IS “flat out wrong” The NYS General Municipal Law Section 239 (m) (i) outlines where this “recommendation” process from the County Planning Board occurs:

   (i) adoption or amendment of a comprehensive plan pursuant to section two hundred seventy-two-a of the town law, section 7-722 of the village law or section twenty-eight-a of the general city law; (ii) adoption or amendment of a zoning ordinance or local law; (iii) issuance of special use permits; (iv) approval of site plans; (v) granting of use or area variances; (vi) other authorizations which a referring body may issue under the provisions of any zoning ordinance or local law - See more at: http://codes.lp.findlaw.com/nycode/GMU/12-B/239-m#sthash.m2bRFD9X.dpuf

So if the county has review over an area variance, which could be something as simple as putting a garage shed 5 feet closer to a lot line then WHY in the name of all reason shouldn’t this process apply to the ANNEXATION OF 507 ACRES??? Do you see the hypocrisy?

if Governor Cuomo vetoed the Skoufis  Annexation bills because he was afraid of being called prejudiced then he is  a bigger dope than we thought and shouldn’t being in charge of anything, much less an entire state.

But Auntie and the Team think that the veto was for other reasons.

This affront by Andy Cuomo was probably a simple case of appeasing the KJ BLOCK VOTE and if so, we don’t know why he bothered, he will not be re-elected. He may have obtained the KJ-Brooklyn block vote but he certainly alienated almost everyone else in the State including members of his own party. The Satmar block vote alone is not enough to guarantee re-election. Bye bye! Andy!

(It is interesting to note that Andy Cuomo waited to the last moment, and that makes one wonder if he was holding out for confirmation of the block vote or more. Just a theory…)

Spokesman for KJ, Ari Felberman, calls for civil discourse and mutual respect “in the best interest of the community,” (BTW which community?) Ari, Auntie and the Team agree!  When is KJ going to do so? After all, “mutual” indicates a two way street. Leaders from the surrounding communities have reached out.!

All we have gotten from your client, The Village of Kiryas Joel, is Auschwitz.

ARI SAID: (referring to Andrew) “was able to see through the angry rhetoric being advances by Assemblyman (James) Skoufis and looked at these bills for what they really were, a thinly veiled attempt to stop the natural growth of the peaceful, family-oriented community of Kiryas Joel.”

You see nieces and  nephews, Ari knows what in is the minds of the Governor and Assemblyman Skoufis because he, too, is a soothsayer with a crystal ball and a pack of Tarot cards in his vest pocket, so he can make statements like that.

What proof does Ari Felberman really have about what is truly in the mind and heart of the assemblyman- on what exactly is he basing this accusation? When did the assemblyman ever say “stop KJ” ?

And note to ALL 62 counties in New York: If you do not want the style of development where your entire county will be one big city, If you think this hostile takeover, resulting in an unsustainable lifestyle, is only going to happen in Kings, Rockland, Orange and Sullivan counties, guess again.

Start checking your property records and see how much property is owned by those who seek to develop high density housing everywhere. Look for corporations such as United Talmudical Academy, J B Realty of Orange, LLC and more.

And realize that your zoning laws will NOT protect you.
