Carmen pleads guilty to three counts of Grand Larceny in the Third
Degree.
Remember Carmen Dubaldi was the Chairman of the New
Windsor Republican Committee. To get on
the committee, he was elected to the
spot by registered Republicans in his town.
Elected official and a County Employee. A Public Servant.

“On December 21, 2015, Vogt pleaded guilty to Grand Larceny in the Third Degree, a Class
“D” felony, before the Judge Donald Williams in Ulster County Court.
He is scheduled to be sentenced on July 19, 2016 in Ulster County to 2 to 4 years in prison if he pays $36,720 to his
victim, or 3 to 6 years in prison if he
cannot pay restitution.
Today, Vogt pleaded guilty before the Judge Michael J.
Obus in New York County Supreme Court to Grand Larceny in the Second Degree, a
Class “C” felony.
He is scheduled to be sentenced on August 4, 2016, to
5 to 10 years in state prison if he pays $120,000 restitution to his victim and
signs a confession of judgment for the remaining amount; if Vogt is unable to
pay the restitution, he will receive a sentence of 6 to 12 years in prison and
must sign a confession of judgment for the entire amount stolen of over
$350,000.
This sentence will run concurrent to his Ulster County
sentence.”
Vogt Convicted On Felony Charges In Both Ulster County
And New York County; Faces Up To 12 Years In Prison
Carmen plead guilty to three counts of Grand Larceny in
the Third Degree. (NY PL 155.35) Grand Larceny in the Third Degree is a
"D" felony (not 3rd degree felony as reported). A “D” Felony is punishable by a minimum of 2 1/3 years to a maximum of 7 years in prison. Mr. Vogt stole money; He plead
guilty to felonies like Carmen's but gets PRISON TIME.
Prosecutors in
Ulster County in Mr. Vogt’s case are asking for minimum of 2-4 years in prison
if he makes restitution.
The Prosecutor from
Ulster County in Carmen’s case is asking for 5 years’
probation with restitution
already made.
Carmen could have been convicted of a “C” felony, for stealing the amount that he stole and
because of:
*(c) use or abuse his position as a public servant by engaging in conduct within or related to his
official duties, or by failing or refusing to perform an official duty, in such
manner as to affect some person adversely. (New York Penal Law
§ 155.40 Grand larceny in the second degree)
In addition to the example above (Mr. Vogt) there are
numerous examples of persons convicted of felonies for similar crimes in the
Times Herald Record and other local papers. What did they get for their crimes?
PRISON TIME!!!!
Maybe Mr. Vogt and those many others did not get letters
of recommendation from local politicos who had much to fear from a loquacious
convicted felon.
Ah! That can’t be it, non-elected officials such as Vogt
and minorities from Kingston, Middletown and Newburgh have plenty of those
letters.

*Carmen abused his position as Republican Chair (New
Windsor) to gain the trust of other elected officials and then stole from them.
He was also the first Vice Chair of the County Republican Committee at one
time.
Carmen’s trials and tribulations are not over. He still
faces civil action from a former New Windsor Town Councilwoman due to his egregious
and demeaning behavior towards her. We wish her an overwhelming victory.

So Auntie, your very concerned Orange County nieces and nephews need your advice. Should we send individual letters to Judge Edward McLoughlin requesting Mr. Dubaldi receive the same treatment as other convicted felons and not receive a pass card because the Ulster DA went "light" on their sentence recommendation? Or should we start a petition and submit that to Judge McLaughlin, prior to the 6/1/16 sentencing date? Or is this all a fait accompli? No matter what we do or say, no jail time for Carmen? Please weigh in on your expert recommendation! As always, thank you for all you do in exposing the corruption within our midst.

Auntie you are spot on DEBALDI violated the PUBLIC TRUST as well as the Republican Party who elected him. What is Debaldi,s empolymnt status with Orange Co. How can a convicted felon enforce OSHA Laws. What action is C.O. Ex. Neuhause going to take on Debaldi,s employment status????
Carmen Dubaldi has been a notorious political operative at times for many republicans in Orange County. He was not for the average citizen and good government. How has he been getting the money to pay back those he stole from? Has he taken from others that we are unaware of? A letter writing campaign must be underway. Have any federal laws been broken? Can Preet help? The Carmen Dubaldi story has much more to be told.
The whole case smells. Is the Judge clued in as to who this guy is and how the Ulster DA has tried to whitewash Dubaldi's crimes? The Judge could be very tough with convincing letters and more investigation that shows CD in a bad way.
Follow the money!
Who says crime politically speaking doesnot pay. Recall all those posh vacations depickekd on Carmen,s Face book page. How about a posh stay at CLUB ATTICA.
The petition idea is a good one.
Dubaldi, in my opinion, is not tough enough for Attica, although, he would probably squeal like a pig once inside.
I am sure some of Carmens cohorts are hoping he doesn't begin to co-operate with the NYS Atty. Genl or the U.S. Atty. Ofc. Re: O.C. POLITICAL Corruption. Lets see if O.C. Ex. Neuhaus dismiss,s Debaldi the NOW admitted Felon or is it business as usual O.C. Style
How does Mr. DuBaldi manage to keep his current COUNTY job in Risk Management Division, where he works as a safety and loss control specialist at $62,000 a year. I thought the county had specific guidelines that must be adhered to by ALL county employees. And it still amazes me that as usual other certain individuals involved in this case have been shielded from any scrutiny. One does not surprise me since he has made it a profession of skating free, but the other victim, I thought had more ethics. But I guess when you run in the right circles you become one of them.

Hard to believe if Preet or for that matter the NYS attorney general became aware of this case they would not be interested. Excellent editorial, above, on Dubaldi.
Citizens would sign a petition against Dubaldi's actions ,all during his political life. He was man who hurt many. Give us some direction Auntie!
Auntie thinks you should start a petition but Auntie is not rendering legal advice here, just giving an opinion. A petition should include language that addresses comparable convictions a/o pleas to a lesser charge and the punishments rendered. It should also include just how heinous his actions over time were and that the letters from the "community" (aka Politicians with something to hide) should not have sufficient weight to consider probation.
We would love to see the pre-sentencing report prepared by Carmen's attorney AND the list of names of those who wrote letters on Carmen's behalf.
Judge McLaughlin is an interesting person, it will be difficult to guess where he will go:
