Legoland cleared a hurdle last Thursday evening when their FEIS (Final Environmental Impact Statement) was accepted by the planning board of Goshen.
The next step for the Legoland application is with the Town Board of Goshen, which must revamp the town code to allow amusement parks. Some of you may be surprised at this but Goshen currently does not allow amusement parks in their zoning, see below.
§ 97-10 Allowable
uses by district; prohibited uses.
A. Purpose. The land use district regulations in this
article are intended to allow flexibility of land use to encourage business and
residential development that is consistent with the character and scale of
Goshen's countryside and neighborhoods. In reviewing applications for special
permits and site plan approval, the Planning Board may impose any conditions it
deems necessary to ensure that a proposed use will be consistent with the goals
of the Comprehensive Plan and compatible with its surroundings. The Planning Board shall deny the plan for any proposed use
which does not satisfy the criteria in this chapter. Sections 97-11 through
97-22 contain regulations specific to each land use district.
B. Use restrictions and Use Table. Structures and land
shall be used only as provided in the Use Table,[1] except as otherwise
provided in this chapter. See § 97-84 for definitions of the use categories. In
the event that a particular proposed use does not fit into one of the
categories shown on the Use Table and is not prohibited by Subsection C, it may
be allowed by special permit issued by the Town Board. (See § 97-70B.) The Use
Table shows allowable uses for all districts except for the AI District, for
which use regulations are contained in § 97-13.

C. Prohibited uses in all
districts.
(1) The following uses are prohibited in all districts:
(a) Any use that violates the environmental performance
standards in § 97-50.
(b) Amusement parks and circuses
and related activities except for a
temporary period on special license from the Town Board.
(c) Junkyards, landfills, dumps, nonmunicipal facilities
for the storage or treatment of sewage sludge, or other solid waste management
facilities, except for composting facilities, as provided in § 97-58C.
(d) The removal of black dirt.
(e) Any building or structure or any part of a drainage
or disposal system located within 100 feet of any watercourse which is part of
a water supply system.
(f) The removal of groundwater for use outside of the
Town of Goshen, including groundwater removed for use in the Village of Goshen
public water supply, except pursuant to a special permit issued by the Planning
Board upon a finding that groundwater recharge measures will be taken to
prevent any negative impact on water quantity or quality within the Town.

Next up at the Town of Goshen Board meeting the Jedi team is back together. RJ IS in Goshen meeting privately wuth Supervisor Bloomfield they are Planning to turn all of route 17A into commercial. Supervisor Bloomfield proclaims anything is possible, he has the Golden Ticket!
Anything is possible if you change the zoning for Legoland you will have to change it for ......whats next? who knows?..could be....Bloomfield says come back in a few weeks he will change it ...has he become the zoning board? Oh yeah that's right if he wants the project he gives it a soft landing, that means no zoning board he will change the zoning for them, Golden will write a name for it and an overlay district for it and will talk it in circles until he convinces himself it's correct AND legal even if it's not.
